Job advertising terms and conditions

Read and consider these terms and conditions carefully before you agree to them. All interested employers seeking to receive Charter Australia's careers services will need to agree to these conditions.
 

Processing advertisements

We aim to process ads to be published within three working days of your request. We recommend advertisers check their ads once posted to ensure they are accurate. Positions can be listed for a maximum of 4 weeks unless otherwise agreed. Advertisers may request republication of their advertisement following expiry.
 

Legal compliance and reserved rights

Advertisers agree to comply with all relevant laws when using the site, including without limitation the: Fair Work Act 2009 (Cth); Anti-Discrimination Act 1977 (NSW); Competition and Consumer Act 2010 (Cth), the Modern Slavery Act 2018 (Cth) and the Fair Trading Act 1987 (NSW). Charter Australia reserves the right to reject, remove or amend any ad without notice and for any reason in its absolute discretion, including where: the advertiser does not comply with these terms and conditions; misleading or incorrect information is provided; a complaint is made; or the advertiser or the ad is determined to be inappropriate or unethical.

Required information

It is your responsibility to provide us with the following required information. Failure to do so may lead to your advertisement not being accepted.
  • full name, address and phone number of the organisation or individual advertising the job
  • full name, business (not personal) email address and phone number of at least one contact person
  • a description of the type of organisation and/or goods or services offered, including any website
  • an Australian Business Number (ABN)
  • an adequate description of the nature of the work and duties being offered, including job title, description/duties, any skills or experience required, faculties targeted, hours on offer, location and application closing date
  • for casual and part-time jobs, the appropriate rate of pay and/or the name of the relevant award or job classification which must comply with the Fair Work Act.

Advertisements we do not accept

Charter Australia posts advertisements at its absolute discretion. The following positions will not be advertised:
  • commission-only or profit share jobs
  • piece rate positions where payment is based on results instead of an hourly or weekly rate (ie. employee gets paid per amount picked, per delivery, per sale made etc)
  • where students are required to submit a business idea or solution as part of the initial job application process
  • where students are required to submit a photo of themselves as part of the application process
  • business or franchise opportunities
  • work involving any illegal activity
  • jobs that offer less than award wages
  • work which requires an employee to purchase a product or service, or offer a security deposit, registration fee, security deposit or similar as a condition of employment
  • positions that involve arrangements where the student receives accommodation (or similar) as payment or partial payment for work performed
  • positions that require applicants to register with an organisation for possible opportunities or make payments to a third party
  • “cash in hand” jobs or positions offering “cash” payments
  • pyramid schemes
  • modelling jobs (except where the business is registered or accredited in this field)
  • work that may involve a serious risk to workers
  • scholarships that are used to pay a student’s wage
  • jobs offered by a foreign employer offering work in Australia who do not have an established Australian office
  • jobs that require a student to have an Australian Business Number (ABN) (including tutoring positions)
  • any advertisement for a role in a tobacco company
  • work that will take place at a residential address (eg cleaning, home help, maintenance, gardening, labouring, childcare, tutoring), except for tutoring positions arranged through a tutoring agency
  • positions that do not appear to represent a genuine employment opportunity

Unpaid work experience and internships

Unpaid positions, or positions that involve a trial period for reduced pay, will only be advertised if they comply with the Fair Work Act. For example, unpaid internships undertaken as a vocational placement as part of an education or training course may be accepted.
 
If you wish to advertise on behalf of a third party, you must meet the following criteria:
  • positions must offer students a genuine opportunity and specify the remuneration
  • no fee must be payable by a student applicant to the agency, employer or any associated party in connection with the position
Advertisers must notify Charter Australia within 7 days if they receive a complaint in relation to an ad, including complaints related to the recruitment process or employment conditions.Where a complaint is made about an advertiser, Charter Australia will apply the following procedure at its discretion:
  • the advertiser may be contacted for a right of reply
  • the advertiser may be informed, where practicable, verbally or in writing if the ad is withdrawn or if access is refused
  • in cases where the complaint reveals information provided in the ad is false or misleading the ad may be immediately withdrawn

The implementation of a complaints procedure mechanism does not mean Charter Australia is in any way responsible for the advertiser or any ads.

Information provided by advertisers is collected by Charter Australia for the purpose of managing requests and inquiries in relation to the site and for related purposes, including:
  • assisting to manage the site, including handling complaints;
  • alerting advertisers of any changes to the site;
  • informing advertisers of any other career services available at Charter Australia
  • in accordance with the Charter Australia's Privacy Policy or as otherwise permitted by law.
  • Charter Australia does not act as an agent for advertisers and is a passive conduit for the publication of ads. It does not endorse or make any representations regarding the ads or their content or the suitability of applicants who respond to those ads.
  • Charter Australia makes reasonable efforts to maintain the functionality of the site but makes no guarantee or warranty that it will be accessible at all times, free of interruptions, without error or free from viruses or other malicious software.
  • To the extent permitted by law, Charter Australia accepts no responsibility and is not liable (including for negligence) for any loss or damage arising from or in connection with use of the site by an advertiser or their agent, including any consequential loss or damage.
  • Advertisers agree to indemnify Charter Australia and its officer, employees and agents, against all claims, demands, damages, costs, penalties and liabilities incurred by Charter Australia (including legal costs) incurred in connection with any breach of these terms by an advertiser, any negligent act or omission of the advertiser or any actual or alleged breach by the advertiser of any law, legislation or regulation.If any part of these terms and conditions is held to be invalid and or unenforceable, that part shall be severed and the remaining terms will continue to be valid and enforceable.
  • These terms and conditions are governed by the laws of the state of New South Wales.
